More and more laws are being passed on the <a href=\"https:\/\/www.tlnt.com\/heres-a-summary-of-key-labor-and-employment-laws-taking-effect-in-2019\/\" target=\"_blank\">state and local level<\/a>, particularly cities and counties, granting expanded protections to employees. In 2018 alone, we experienced a flurry of new laws covering issues like minimum wage, paid sick leave, pregnancy accommodation, sexual harassment and more. <\/p>\r\n<p>With each new law, there\u2019s a potential <a href=\"https:\/\/www.postertracker.com\/state-labor-law-posters?catpath=allstatelaborlawposters%28vpostertracker%29.3.1\" target=\"_blank\">poster update or new poster issued<\/a>. It takes nearly constant awareness and action to keep your business fully compliant. To help you enter the new year on the right foot, I\u2019m going to address the major trends we\u2019ve seen in the past year affecting labor law posting compliance, including specific posting changes you need to know about. I\u2019ll also share what we\u2019re currently watching, so you\u2019ll have a sense of what is pending and likely to affect your postings in 2019. <\/p>\r\n<h2>First Up: Federal-Level Changes<\/h2>\r\n<p>In 2018, there were no mandatory changes to any of the six federal postings required for employers with 50 or more employees: EEOC, OSHA, FMLA, USERRA, FLSA and EPPA. However, for 2019, some legislation is pending that could impact these federal labor law posters, including:<\/p>\r\n<ul>\r\n  <li>Workflex in the 21St Century Act<\/li>\r\n  <li>Family and Medical Insurance Leave Act (FAMILY Act)<\/li>\r\n  <li>Economic Security for New Parents Act<\/li>\r\n  <li>Federally mandated E-Verify<\/li>\r\n<\/ul>\r\n<p>Note, too, that a change to the \u201cEEO Is the Law\u201d poster issued by the EEOC is also pending. This mandatory update is based on a 2015 law prohibiting discrimination due to sexual orientation and gender identity, as well as a 2014 law expanding veteran protections.<\/p>\r\n<h2>What We\u2019re Seeing with State Labor Law Compliance<\/h2>\r\n<!-- Did you know? Stacked -->\r\n<div class=\"smartTip row\">\r\n  <div class=\"col-xs-12 \">\r\n    <img class=\"img-responsive\" id=\"SmartTip\" src=\"https:\/\/www.hrdirectapps.com\/blog\/wp-content\/themes\/hrdirectapps\/images\/did-you-know.jpg\">\r\n  <\/div>\r\n  <div class=\"col-xs-12 smartTipContent\">\r\n    <p>\r\n      There are approximately 150 state law poster changes per year, and more than 50% require immediate mandatory replacements.\r\n    <\/p>\r\n  <\/div>\r\n<\/div>\r\n<p>On the state level, compliance gets a lot more involved. In addition to displaying a set of <a href=\"https:\/\/www.hrdirectapps.com\/blog\/small-business-labor-law-poster-faq\/\" target=\"_blank\">six federal<\/a> posters, employers must post several state-issued employee notices at each posting site. More states and cities are giving employees expanded protections beyond what federal law provides, and this is what triggers the majority of poster changes.<\/p>\r\n<p>For example, several states passed laws in 2018 aimed to reduce sexual harassment in the workplace, which required new or updated postings that year: California, Delaware, Illinois and Vermont. <\/p>\r\n<p>Further, there were these additional state-level legislative changes:<\/p>\r\n<h3>OSHA<\/h3>\r\n<ul>\r\n  <li><strong>Alaska, Virginia, Wyoming <\/strong>&mdash; Updated OSHA posters to incorporate information about OSHA\u2019s new penalty amounts for various violations<\/li>\r\n  <li><strong>Hawaii, South Carolina <\/strong>&mdash; Updated OSHA posters to incorporate new federal OSHA recordkeeping requirements for work-related accidents and fatalities<\/li>\r\n<\/ul>\r\n<h3>Pregnancy Discrimination<\/h3>\r\n<ul>\r\n  <li><strong>New Jersey, South Carolina, Vermont <\/strong>&mdash; Updated or issued new posters addressing pregnancy discrimination and clarifying employer responsibilities to provide reasonable accommodations<\/li>\r\n<\/ul>\r\n<h3>Paid Sick Leave<\/h3>\r\n<ul>\r\n  <li><strong>Maryland, New Jersey, Rhode Island <\/strong>&mdash; New posters were issued based on laws requiring employers to offer paid sick leave (beyond limited federal provisions)<\/li>\r\n<\/ul>\r\n<h3>Minimum Wage<\/h3>\r\n<p>A large number of state posting changes involved minimum wage increases. In 2018, 13 states had minimum wage increases that required posting changes: Alaska, Arizona, Colorado, Florida, Maine, Minnesota, Missouri, Montana, New Jersey, New York, Ohio, Oregon and Rhode Island. (Other states had increases, but previous versions of posters remained compliant.) <\/p>\r\n<p>And now for the new year, the following states announced minimum wage increases and have already issued new posters for 2019:<\/p>\r\n<div class=\"divTable\">\r\n  <div class=\"divTableBody\">\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Alaska<\/div>\r\n      <div class=\"divTableCell\">$9.89<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Arizona<\/div>\r\n      <div class=\"divTableCell\">$11.00<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Arkansas<\/div>\r\n      <div class=\"divTableCell\">$9.25<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">California<\/div>\r\n      <div class=\"divTableCell\">$12.00 (employers with 26+ employees)<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Colorado<\/div>\r\n      <div class=\"divTableCell\">$11.10<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Delaware<\/div>\r\n      <div class=\"divTableCell\">$8.75<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Florida<\/div>\r\n      <div class=\"divTableCell\">$8.46<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Maine<\/div>\r\n      <div class=\"divTableCell\">$11.00<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Massachusetts<\/div>\r\n      <div class=\"divTableCell\">$12.00<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Minnesota<\/div>\r\n      <div class=\"divTableCell\">$9.86 (annual gross revenues of $500,000+)<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Missouri<\/div>\r\n      <div class=\"divTableCell\">$8.60<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Montana<\/div>\r\n      <div class=\"divTableCell\">$8.50<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">New Jersey<\/div>\r\n      <div class=\"divTableCell\">$8.85<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">New York<\/div>\r\n      <div class=\"divTableCell\">Variable, based on location<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Ohio<\/div>\r\n      <div class=\"divTableCell\">$8.55<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Rhode Island<\/div>\r\n      <div class=\"divTableCell\">$10.50<\/div>\r\n    <\/div>\r\n    <div class=\"divTableRow\">\r\n      <div class=\"divTableCell\">Vermont<\/div>\r\n      <div class=\"divTableCell\">$10.78<\/div>\r\n    <\/div>\r\n  <\/div>\r\n<\/div>\r\n<br>\r\n<p>Note: A Michigan minimum wage of $9.45 goes into effect March 29, 2019, and a poster hasn\u2019t yet been released. <\/p>\r\n<!-- Did you know? Stacked -->\r\n<div class=\"smartTip row\">\r\n  <div class=\"col-xs-12 \">\r\n    <img class=\"img-responsive\" id=\"SmartTip\" src=\"https:\/\/www.hrdirectapps.com\/blog\/wp-content\/themes\/hrdirectapps\/images\/did-you-know.jpg\">\r\n  <\/div>\r\n  <div class=\"col-xs-12 smartTipContent\">\r\n    <p>\r\n      <a href=\"https:\/\/www.hrdirectapps.com\/blog\/avoid-labor-law-poster-penalties\/\" target=\"_blank\">Non-compliance can be costly<\/a>. Government posting fines on the federal level recently increased to $34,000+ per violation. State and local fines typically range from $100-$1,000 each. \r\n    <\/p>\r\n  <\/div>\r\n<\/div>\r\n<h2>Drilling Down Even Further: City and County Posting Compliance<\/h2>\r\n<p>I\u2019m not going to get into all the details here, but you should know that the number of cities and counties requiring employers to post notices is growing, too. In general, these postings cover employment laws similar to the state posters \u2013 minimum wage, paid sick leave, prohibition against discrimination and sexual harassment \u2013 but cities have the discretion to pass laws offering more protections. <\/p>\r\n<p>For example, in California alone, 14 cities increased their minimum wages and issued new postings, effective January 1, 2019. Further still, a handful of city\/county posting changes covering minimum wages, earned sick leave and paid sick leave are still pending in 2019 for cities in California, New York and Texas. <\/p>\r\n<p>And to answer a question that comes up a lot: Yes, <a href=\"https:\/\/www.hrdirectapps.com\/blog\/san-francisco-labor-law-postings-infographic\/\" target=\"_blank\">you must post the city posters in addition to the state and federal<\/a>.
